
The European Union has approved the 12th package of sanctions against Russia. These new measures introduce additional restrictions on the export of dual-use items and advanced technological and industrial goods (Annex VII).
The new measures, published in the Official Journal of the European Union, came into force on 19 December 2023.
In particular :
- New export controls on dual-use/advanced technology goods, including chemicals, thermostats, DC motors and servomotors for unmanned aerial vehicles (UAV), machine tools and machinery parts.
- New export bans on EU industrial goods, including machinery and spare parts, construction-related goods, processed steel, copper and aluminium goods, lasers, and batteries.
- The addition of 29 Russian and third country entities to the list of entities associated to Russia's military-industrial complex - Annex IV (including entities registered in Uzbekistan and Singapore).
- Prohibition to provide enterprise and design-related software to the Russian government or Russian companies. The aim is to further hamper Russia's capacities in its industrial sector.
We draw your attention to the new Article 12g which introduces the obligation to include a clause to prohibit re-export to Russia:
"When selling, supplying, transferring or exporting to a third country, with the exception of partner countries listed in Annex VIII to this Regulation, goods or technology as listed in Annexes XI, XX and XXXV to this Regulation, common high priority items as listed in Annex XL to this Regulation, or firearms and ammunition as listed in Annex I to Regulation (EU) No 258/2012, exporters shall, as of 20 March 2024, contractually prohibit re-exportation to Russia and re-exportation for use in Russia"
2. Paragraph 1 shall not apply to the execution of contracts concluded before 19 December 2023 until 20 December 2024 or until their expiry date, whichever is earlier."
